By using this website and any of it's related services, it is assumed that you agree to the terms laid out below. Do not continue to use the Patch Web Design website if you do not accept all of the terms and conditions stated on this page.

The following terminology applies to these Terms: “Client”, “You” and “Your” refers to you, the person accessing this website or engaging in business with us, and accepting the Company’s terms and conditions. “The Company”, “Myself”, “I”, and “Me”, refers to the Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. All terms refer to the offer, acceptance and consideration of payment necessary to undertake the process of our assistance to the Client in the most appropriate manner, whether by formal meetings of a fixed duration, or any other means, for the express purpose of meeting the Client’s needs in respect of provision of the Company’s stated services/products, in accordance with and subject to, prevailing law of Australia. Any use of the above terminology or other words in the singular, plural, capitalisation and/or he/she or they, are taken as interchangeable and therefore as referring to same.

I am committed to providing you with the best possible customer service experience. I am bound by the Privacy Act 1988 (Cth), which sets out a number of principles concerning the privacy of individuals.

Collection of your personal information

There are many aspects of the site which can be viewed without providing personal information, however, for access to future customer support features you are required to submit personally identifiable information. This may include but not limited to a unique username and password, or provide sensitive information in the recovery of your lost password.

I may occasionally hire other companies to provide services on my behalf. Those companies will be permitted to obtain only the personal information they need to deliver the service. I will take reasonable steps to ensure that these organisations are bound by confidentiality and privacy obligations in relation to the protection of your personal information.

For each visitor to reach the site, I expressively collect the following non-personally identifiable information, including but not limited to browser type, version and language, operating system, pages viewed while browsing the Site, page access times and referring website address. This collected information is used solely internally for the purpose of gauging visitor traffic, trends and delivering personalized content to you while you are at this Site.

From time to time, I may use customer information for new, unanticipated uses not previously disclosed in my privacy notice. If our information practices change at some time in the future, only data collected from the time of the policy change forward will adhere to our updated practices.

You have a right to access your personal information, subject to exceptions allowed by law. If you would like to do so, please let me know. Terms and Conditions

The following terms and conditions apply to all agreed works between Patch Web Design and its clients

1. Fees

All fees quoted are applicable to works detailed in the quote and the brief (if supplied). Any further works requested outside of the quote will incur an additional charge. It is your responsibility to confirm that all required work is included in the quote.

2. Payments

A 50% deposit is payable upon acceptance of the quote. The remainder is payable within 3 days of the work being completed.
For website packages, the website will go “live” once the final balance is paid. Failure to pay the remaining balance will result in the website being removed.

3. Information Required From You

During the project I may require information from you, which may include, but is not limited to, copy, images, or branding such as logos or banners. If there is a delay in supplying any required information, then this will delay any previously agreed timescales.

4. Consultations

Any quote given will include an initial consultation to gather all required information for the project. Website packages also include a midway consultation. Any further consultations will incur an additional charge.

5. Variations

All work to be undertaken will be detailed in the quote or brief. Any variation to these works may incur an additional charge, which will be advised at the time.
For website packages, the layout prior to the inclusion of any text or images, will be shown during the midway consultation. At this point, any changes required will be discussed and agreed upon. These changes (within reason) are included in the total cost. Any further changes past this point may incur an additional charge, which will be advised at the time.

6. Cancellation of work

Once a deposit is paid, the project is considered agreed to, and work will commence. Any cancellation that occurs after this point will result in a loss of deposit, except in the case where no work has been undertaken.
All cancellations must be requested in writing.

7. Rejection of work

If work is completed but rejected by you without Patch Web Design being given the opportunity to amend the work, the work will be considered as completed, and steps will be taken to recover payment for the completed work.

8. Ownership of work

Once work is completed and the final balance of all invoices is paid, you become the owner of said work and may use it as you wish. Until this point, Patch Web Design remains the owner and no work may be copied, published or distributed.
The only exception to this is websites, where the layout and design of the website remains the property of Patch Web Design. All content (text, images, etc) included in the website remains the property of the rightful owner.
Should you wish to transfer the website away from Patch Web Design, you may do so upon agreement. There may be a fee involved to do this, which will be confirmed at the time.

9. Website Hosting

Should you engage Patch Web Design to manage your website, this will be done under my own hosting account with a web hosting provider. If you wish to host your website elsewhere, I can include a setup in the quote, however I regret that I will be unable to manage your site for you.
The hosting and management fee is payable monthly or yearly as agreed at the time of quote. Failure to pay this fee will result in removal of the website.

10. E-Commerce Websites

You are responsible for complying with all relevant laws relating to e-commerce. and to the full extent permitted by law will hold harmless, protect, and defend and indemnify Patch Web Design and its subcontractors from any claim, penalty, tax, tariff loss or damage arising from your or your clients’ use of Internet electronic commerce.

11. Subcontracting

Patch Web Design reserves the right to sub-contract any works agreed to.

12. Promotional material

Patch Web Design reserves the right to use client websites, web designs, layouts, prototypes, wireframes and collateral in advertising and / or marketing initiatives. This may include portfolio examples on our website, case studies and other promotional initiatives.
